Non-nomination appeal – 2020 Winter Youth Olympics – Appellant argued that undue weight had been placed on one-off performances that he had been unable to attend – Appellant further argued that his results over an extended three month period established that he was the number one ranked male athlete – The Tribunal noted the extensive material made available to it, but was unable to find evidence of cherry picking by selectors, bias, an appearance of bias or any unfairness – The Tribunal determined that the exercise undertaken within the sport and by the New Zealand Olympic Committee were in accordance with the prevailing protocols, and that the discretions exercised were available and rational – appeal dismissed
