Appeal against decision of NSO – non-nomination – both H and S appealed decision of Archery New Zealand (ANZ) to not nominate either to NZOC to compete at the Tokyo Olympic Games – appeals heard together – urgency due to requirement to confirm quota allocation with World Archery – H and S appealed ANZ failure to properly follow and / or implement nomination criteria – H and S said they had fulfilled criteria – ANZ’s assessment of their results was incorrect – ANZ said H and S scores below standard required – criteria stipulated top 16 place at a key world event 2019/21 – H and S produced alternative assessment of performances and results that capable of achieving top 16 place – Tribunal found H and S statistical information subjective and outside criteria – H and S did not meet essential nomination criteria – ANZ assessment of competition scores against criteria correct – Tribunal dismissed appeals
